Renne Public Law Group (RPLG) Senior Associate Spencer Wilson will present a session on “The Future of the Regular Rate: Emerging Changes to the Fair Labor Standards Act Post-Flores” on Friday, October 12, from 8:00 – 9:15 a.m., at the Public Employer Labor Relations Association of California (PELRAC) Annual Conference in Anaheim.
“For years, the FLSA has served as a trap for the unwary public employer. This is due in large part to the fact that the FLSA’s intricate overtime requirements can be difficult to administer in conjunction with the often complex pay arrangements found in labor contracts,” stated Wilson. “Employers who unwittingly violate the law have traditionally had few options to resolve their cases. However, this area of law is changing quickly and recent developments in the U.S. Supreme Court and the Department of Labor provide some room for employer optimism.”
Following the Ninth Circuit’s sweeping 2016 decision in Flores v. San Gabriel, public agencies have seen a surge of FLSA lawsuits alleging failure to include a variety of bargained-for benefits in the regular rate of pay. Wilson will examine this developing area of law, including new developments at the U.S. Supreme Court and the Department of Labor, and discuss the various options available to public agencies facing regular rate challenges.
